Jack and Betti Schmitt claimed that their rap star nephew unjustly evicted them from the home he had built for the couple in Missouri, America.



They claim that in 2002 they moved to Michigan at the request of Marshall Mathers III who had agreed to pay them $100,000 a year for five years.



They were also expecting a $350,000 home but the couple say they've only received $165,000 since 2002 and, on top of that, a notice to leave the property.



Eminem's attorney argued in court that no work was performed for the money the Schmitts received, and there was no contract proving otherwise.



The judge eventually decided that the couple could pursue a claim that the rapper unjustly profited from the improvements they made to their original home, and could also amend the lawsuit in the next two weeks to reinstate the other claims should they so wish.
